Summary

Case-Based Criminal Law is one of Professor Chen Xingliang's representative works and the first monograph in China to study criminal law cases within a systematic theoretical framework. First published in 2009 as a two-volume set, it was later followed by a teaching edition and a second edition; in 2024, China Renmin University Press released a two-volume hardcover third edition as volumes in the Criminal Law Series. The book's basic position is that case-based criminal law is a jurisprudence that depends on and derives from cases. Taking real cases as its basic thread and medium, the author examines major issues in both the general and specific parts of criminal law case by case, while critically assessing the reasoning methods used in judicial process, striving to build a bridge between interpretative and applicative theory across statutory provisions and concrete cases. The first volume covers the general part, beginning with a comparative study of case method teaching across legal traditions and proceeding through topics including criminal law interpretation, the body of crime, culpability, inchoate offenses, joint crime, unit crime, concurrence of offenses, sentencing, and application of penalties. The second volume covers the specific part, organized by categories of offenses, addressing crimes endangering public safety, crimes disrupting the order of the socialist market economy, crimes infringing personal rights, crimes infringing property, crimes obstructing the administration of social order, crimes of embezzlement and bribery, and crimes of dereliction of duty. Each volume includes a case-name index, a subject index, and a combined case-name and subject index for easy reference and study. Combining the systematic structure of a textbook with the depth of specialized research, the book has long been regarded as an important model for case-based criminal law research and is suitable for law students, criminal law researchers, and criminal justice practitioners.

Editor's review
